 Judge Koh Awards Apple 600 Million in Damages; Order New Trial for Some Products (Apple vs Samsung) – Judge Koh stated that the jury’s decision was based on impermissible legal theories.

Judge Koh Awards Apple 600 Million in Damages; Order New Trial for Some Products (Apple vs Samsung)

After many months of deliberating Judge Koh has finally issued her ruling in the Apple vs Samsung case. From the looks of things, Judge Koh decided to partially grant each camp their wish. She awarded Apple US$600 million in damages, while granting Samsung a new trial over several products.

“The judge overseeing the Apple-Samsung patent trial on Friday threw out part of the billion dollar verdict in the case, ordering a new trial for certain products in the case,”  . “Judge Lucy Koh ordered a new trial to determine damages for certain of the products in the case, a move that affects $450 million of the jury’s $1.05 billion award.”

According to Fried, Judge Koh stated that the jury’s decision was based on impermissible legal theories.

[quote] Because the Court has identified an impermissible legal theory on which the jury based its award, and cannot reasonably calculate the amount of excess while effectuating the intent of the jury, the Court hereby orders a new trial on damages for the following products: Galaxy Prevail, Gem, Indulge, Infuse 4G, Galaxy SII AT&T, Captivate, Continuum, Droid Charge, Epic 4G, Exhibit 4G, Galaxy Tab, Nexus S 4G, Replenish, and Transform.[/quote]

However, Koh left intact the ruling on 14 other products, upholding nearly $600 million in damages, according to the report.
