The ‘billion dollars’ trial is now in full swing and as usually the proceeding is full of drama. On Tuesday Samsung sent excluded evidences to various news outlet for publication. This obviously did not go down well with Judge Koh. She asked Samsung’s legal team to explained their behaviour.
This is what John B. Quinn, of Samsung’s law firm Quinn Emanuel Urquhart & Sullivan, LLP had to say:
Contrary to the representations Apple’s counsel made to this Court, Samsung did not issue a general press release and more importantly, did not violate any Court Order or any legal or ethical standards….. These false representations by Apple’s counsel publicly and unfairly called my personal reputation into question and have resulted in media reports likewise falsely impugning me personally.
This response was not to Apple’s legal team satisfaction. Apple’s counsel William Lee had this to say:
Mr. Quinn’s declaration does not address two of the Court’s questions: who drafted the statement and who released it. Samsung’s multiple references to the jury in its statement make plain its intent that the jurors in our case learn of arguments the Court has excluded through the press
In response, Mr. Lee has filed an “emergency motion for sanctions” as well as “other relief that may be appropriate.”
